Regular meeting of the Otselic Town Board on April 11, 2023, 7:00 p.m., Town Hall, South Otselic, New York
Present: Marjorie Davis, Supervisor; Sadie Allen, Charles Bishop, Jr., Darryl Fox and Jay Graham, Town Council; Louise Perry, Town Clerk

Minutes from the March 15, 2023 were distributed. Motion by D. Fox and seconded by S. Allen to approve the minutes. CARRIED 4-0, 1 abstain C. Bishop, Jr.
Chenango County Highway Department has submitted a proposal for the Town of Otselic Highway Department to mow the 20.92 miles of county highways in the Town of Otselic at a rate of $85/mile.
There are 4 students interested in working as lifeguards. Supv. Davis will ask Chenango County for assistance to help pay for the training.
Regarding the Town property on Kellogg Lane: Asbestos has been found in the sheetrock in one room. Chenango County Building and Fire Code stated that if the building is condemned it is possible to do a wet demolition.
C. Bishop suggested that NYSEG should be asked to cut some trees on Stage Road.
D. Fox will attend the Town of Georgetown board meeting in May to learn more about their Comprehensive Plan progress. The April water superintendent class was full but he may be able to attend one in June or October.
S. Allen commented that residents have been having problems with the availability of the dog control officer and him returning phone calls.
Clerk Perry received a letter from the Chenango County Board of Elections requesting use of the Town Hall for a State and Local Primary on June 27 and General Election November7. The Annual Water Quality Report for 2022 for the South Otselic Water District was prepared by the Chenango County Health Department and will be distributed to all customers. An email was received from State ConnectALL regarding a listening session on April 24 to develop the State’s Digital Equity Plan. There are still approximately 16 water meters that are not working.
Resolution #3-2023 A RESOLUTION APPROVING LOCAL LAW NO. 1-2023

WHEREAS, notice was given that the Town Board scheduled a public hearing for February 14, 2023 at 7:10 p.m. for Local Law #1 of the year 2023 entitled “A Local Law Repealing and Replacing Local Law #2-1989 Entitled ‘Site Plan Review Law’ and Repealing Local Law#1-1993 and Local Law #1-2005 Entitling said Law Subdivision Regulations of the Town of Otselic; and
WHEREAS, notice of said pubic hearing was duly advertised in the official newspaper of the Town and posted on the Town Clerk’s signboard; and
WHEREAS, said public hearing was duly held on the 14th day of February, 2023 at 7:10 p.m. and all parties in attendance were permitted an opportunity to speak on behalf of or in opposition to said proposed Local Law, or any part thereof; and
WHEREAS, the Town Board, after due deliberation, finds it in the best interest of the Town to adopt said Local law.
NOW, THEREFORE BE IT RESOLVED that the Town Board of the Town of Otselic hereby adopts said local law as Law No. 1 of the Year 2023 entitled entitled “A Local Law Repealing and Replacing Local Law #2-1989 Entitled ‘Site Plan Review Law’ and Repealing Local Law#1-1993 and Local Law #1-2005 Entitling said Law Subdivision Regulations of the Town of Otselic; and it is further
RESOLVED that the Town Clerk be and hereby is directed to enter said Local Law in the minutes of this meeting and give due notice of the adoption of said Local Law to the Secretary of State.

Candace Balmer from Rural Community Assistance Partnership Solutions has a meeting scheduled Wednesday with Supv. Davis to gather more information on water accounts in the district. A SOWD Advisory Committee meeting will also be held that afternoon
Resolution #5-2023 Offered by D. Fox
A RESOLUTION DECLARING THE WATER SYSTEM IMPROVEMENTS FOR THE SOUTH OTSELIC WATER DISTRICT PROJECT WILL NOT HAVE A SIGNIFICANT ENVIRONMENTAL IMPACT AND FILING OF A NEGATIVE DECLARATION-NOTICE OF NON-SIGNIFICANCE DETERMINATION
WHEREAS, the Town of Otselic, as Lead Agency, has completed Parts 2 and 3 of the full Environmental Assessment Form (EAF);
WHEREAS, the Town of Otselic has consulted with all involved agencies identified including: Federal, State, County and Local agencies;
WHEREAS, the Town of Otselic hereby determines and declares that the Project will not have a significant environmental impact and has filed a Negative Declaration-Notice of Non-Significance Determination;
WHEREAS,the Town of Otselic maintains copies of all correspondence on file to support the forementioned declaration;
WHEREAS,the Town of Otselic will prepare, file, and publish its determination of significance in the Environmental Notice Bulletin and The Evening Sun.

Clerk Perry received a request from the Chenango County Public Health Department requesting use of the Town Hall the morning of May 16 for a food safety class. There were no objections to this request.
Resolution #6-2023 Raffle Sales in Town Park Offered by Supv. M. Davis
WHEREAS, the Perry cook American Legion Post #973 Auxiliary of South Otselic and the Otselic Valley Fishing and Heritage Association have each submitted a written request asking for permission to conduct a raffle in the town owned public park on Fishing Heritage Day, May 20, 2023;
AND WHEREAS, the Town of Otselic has no policy concerning raffles on municipal property;
AND WHEREAS, upon research and also advice from County Attorney Z. Wentworth, it has been determined that raffles can be legally conducted on municipal property with local town board approval via town law, ordinance or resolution;
THEREFORE, BE IT RESOLVED, that permission be granted to the Legion Auxiliary and Fishing Heritage Association to hold raffles in the town park on Fishing Heritage Day May 20, 2023.

There was a discussion about a town clean-up day, tentatively planned for May 13. The dumpsters would be at the Highway Garage this year and supervision was suggested.
D. Fox would like the Town to consider membership in the Association of Towns. Membership would cost $500/year.
Supv. Davis will ask our insurance representative Dan Grady about reimbursement for attorney fees resulting from the Chavez variance petition.
Historian M. Sheridan estimates a budget of less than $400 for the event on July 8 for advertising and refreshments.
Supv. Davis presented her financial reports.
